This course covers the laws and rules governing the practice of dentistry in Florida. Specifically, the lecture discusses Chapters 456, and 466, of the Florida Statutes, as well as Chapter 64B5 of the Florida Administrative Code.
Chapter 456, F.S. covers the general provisions applicable to all health professions and occupations. The course discusses common grounds for disciplinary action under Chapter 456, as well as lesser known provisions that are important to dental professionals. Chapter 466, F.S. is the Dental Practice Act. The course covers the purpose of the Act, the creation of the Board of Dentistry, and grounds for disciplinary action.
Chapter 64B5 of the Florida Administrative Code is covered in the most depth. This Chapter covers all the rules promulgated by the Board. The course covers these rules as they are applied to education, experience, and examination requirements, grounds for disciplinary proceedings and disciplinary guidelines, advertising and solicitation guidelines, license requirements, status, renewals, reactivation, and exemptions, continuing education requirements, and delegation of remediable tasks.
The course goes on to discuss the disciplinary process in Florida. Each step is described, including filed complaints, the investigation stage, probable cause determination, litigation, board action, and appeal. Samples of common documents received in the disciplinary process are included. Most importantly, the course covers the rights and obligations imposed on dental professionals during the investigatory and disciplinary process.
Next, the course provides information on recent rule changes and newly enacted laws. One of the most important new laws passed during the 2009 legislative session was SB1986. It is covered in detail, along with its application to dental professionals.
Lastly, the course lists 10 ways for dental professionals to avoid getting in trouble with the Board. These include such matters as verifying the credentials and licensure of dentists, hygienists, and assistants employed under a dental practitioners practice, ensuring accurate and timely renewal of the practitioner’s license, and maintain comprehensive documentation.
